Additional Policy, Compliance & Protocols

Article 1 – Additional Policy Documents Relevant legal basis: General Data Protection Regulation (GDPR), Dutch GDPR Implementation Act (UAVG), Telecommunications Act, Book 6 Dutch Civil Code (consumer law), PSD2/payment regulations, Digital Services Act (where applicable), tax legislation, and other applicable Dutch and European laws and regulations.
- Class26 may maintain additional policy documents, guidelines, and protocols in support of: • Platform safety • Privacy and data protection • Quality assurance • Payment processing • Moderation • Consumer protection • Operational execution • Fraud prevention • Compliance with applicable laws and regulations
- These additional documents may include, among others: • Privacy Policy • Cookie Policy • Data Processing Agreement • Refund & Cancellation Policy • Community Guidelines • Expert Conduct Policy • Moderation Policy • Incident Protocol • Complaints Procedure • Payout Policy • Intellectual Property Policy • AI & Content Usage Policy • Notice & Takedown Policy • GDPR and Data Breach Protocol
- Class26 reserves the right to amend, update, or expand these documents from time to time if necessary due to: • Changes in laws and regulations • Platform development • Safety considerations • Operational necessity • Quality assurance • Fraud prevention • Consumer protection • International scalability • Changes required by payment providers or regulatory authorities
- The most current version of additional policy documents may be made digitally available through the Class26 platform or website.
Article 2 – Complaints, Incidents, and Platform Safety Relevant legal basis: Section 6:74 Dutch Civil Code (breach of contract), Section 6:89 Dutch Civil Code (duty to complain), Section 6:162 Dutch Civil Code (unlawful act), GDPR, and consumer protection under Book 6 Dutch Civil Code.
- Class26 may maintain internal procedures regarding: • Complaints • Disputes • Refunds • Boundary-crossing behavior • Fraud • Platform safety • Data breaches • Account abuse • Moderation and content review
- Experts are required to reasonably cooperate with: • Investigations • Complaint handling • Safety measures • Compliance requests • Identity or verification checks • Fraud prevention • Platform investigations
- Class26 reserves the right to take temporary or permanent measures to protect: • Users • Experts • Payment processing • Platform safety • Reputation • Continuity of the platform
- These measures may include: • Warnings • Temporary suspension • Limitation of visibility • Temporary suspension of payouts • Removal of content • Cancellation of bookings • Termination of accounts or collaborations
- In cases of suspected fraud, misleading conduct, illegal activities, data breaches, or serious violations of platform safety, Class26 may take immediate action without prior warning.
Article 3 – Consumer Rights, Digital Content, and Distance Services Relevant legal basis: Sections 6:230m et seq. Dutch Civil Code (consumer information obligations), Sections 6:230o et seq. Dutch Civil Code (right of withdrawal), Section 6:230p Dutch Civil Code (exceptions to withdrawal rights), regulations regarding digital content, and consumer protection under Book 6 Dutch Civil Code.
- Additional legal rules may apply to digital products, livestreams, online courses, coaching, training, and other digital or remotely provided services regarding: • Right of withdrawal • Refunds • Immediate delivery • Digital access • Consumer protection • Information obligations
- Where legally required, Class26 may request additional consents, confirmations, checkboxes, or verifications during: • Checkout • Onboarding • Registration • Purchase • Delivery of digital content
- Experts are required to provide accurate, clear, transparent, and non-misleading information regarding: • Prices • Offerings • Content of services • Availability • Results • Certifications • Expertise • Applicable terms and conditions
- Digital products, downloads, online courses, livestreams, and other digital content may fall under statutory exceptions to the right of withdrawal once delivery or access has started and the User has explicitly agreed in advance to immediate delivery.
- Experts may not use misleading claims, fake reviews, unfounded guarantees of results, or prohibited commercial practices.
Article 4 – Privacy, Personal Data, and Data Protection Relevant legal basis: General Data Protection Regulation (GDPR), Dutch GDPR Implementation Act (UAVG), Telecommunications Act.
- The Parties shall process personal data exclusively in accordance with applicable privacy laws and regulations.
- Experts may only use personal data for the execution of services through the platform.
- Experts are not permitted to use personal data of users outside the platform for: • Unsolicited acquisition • Spam • Commercial approaches outside the platform • Sales outside Class26 • Unauthorized marketing
- Class26 may impose additional security, privacy, and verification measures if deemed necessary for safety, compliance, or consumer protection.
- In the event of potential data breaches, security incidents, or unauthorized access, Experts must immediately notify Class26.
Article 5 – Payment Processing, Payouts, and Compliance Relevant legal basis: Section 6:114 Dutch Civil Code (payment), PSD2/payment regulations, tax legislation, and the Dutch Anti-Money Laundering and Anti-Terrorist Financing Act (Wwft), where applicable.
- All payments shall be processed through Class26 or payment providers designated by Class26.
- Class26 may carry out additional verifications relating to: • Identity • Banking details • Business details • Tax information • Fraud checks • Chargebacks • Payment security
- Class26 reserves the right to temporarily suspend payouts if: • A fraud investigation is ongoing • Chargebacks occur • Serious complaints exist • Laws or regulatory authorities require this • Additional verification is necessary
- Experts remain independently responsible for: • Tax filings • VAT obligations • Administration • Insurance • Compliance with applicable laws and regulations within their professional field
Article 6 – Applicable Laws and Regulations Relevant legal basis: Dutch Civil Code, consumer law, GDPR, Telecommunications Act, tax legislation, PSD2/payment regulations, regulations regarding digital content, regulations regarding unfair commercial practices, and other applicable Dutch and European laws and regulations.
- The Parties shall act in accordance with applicable Dutch and European laws and regulations.
- If future legislation, case law, supervisory requirements, or platform developments require amendments to these terms or policy documents, Class26 may reasonably amend these terms and policy documents.
- If any provision of this agreement or additional policy documents is found to be invalid or unenforceable, the remaining provisions shall remain fully in force and effect.
- In such case, the Parties shall consult with each other in order to replace the relevant provision with a legally valid provision that reflects as closely as possible the purpose and intent of the original provision.
